Our probate practice

Probate is the legal process by which an individual's debts are paid and assets are distributed to beneficiaries upon his or her death. All property titled solely in the decedent's name is considered an asset of his or her probate estate. The probate estate owns these assets until their final distribution.

For estate tax purposes, an estate is defined as the total collection of a decedent's assets whether or not they are put through probate. Administration of the decedent's estate is the distribution of both the decedent's probate and non-probate assets.

To ensure a decedent's estate assets are transferred properly, one should seek the expertise of a law firm qualified in the area of probate and estate law.
